1. Acceptance of These Terms

These Terms of Service (the “Terms”) govern your access to and use of the jaqvenric website and any educational materials, templates, checklists, and training content made available through it (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

You must be at least 16 years old to use the Services. If you are under the age of majority in your country, you may use the Services only with the involvement and permission of a parent or legal guardian.

Our Privacy Policy is incorporated by reference into these Terms and explains how we handle personal data.

2. Educational Disclaimer (No Guaranteed Results)

The Services provide educational information about bicycle sales, customer consultation, retail communication, and product knowledge. The materials are intended to support training and internal process alignment, not to provide a guarantee of performance.

Outcomes vary widely depending on factors such as inventory availability, pricing strategy, team experience, store traffic, seasonality, local competition, and how consistently a team applies a consultative sales flow. For that reason, jaqvenric does not guarantee specific sales figures, conversion rates, revenue outcomes, or business results.

Any examples, scenarios, or practice prompts are illustrative and are not promises of future performance.

3. Description of the Services

The Services may include training modules, written guidance, role prompts, consultation scripts, checklists, and recommended workflows for bicycle retail environments. Content may cover topics such as needs discovery, “spec-to-outcome” explanations, test-ride setup, sizing conversation guardrails, objection handling, and handover routines.

We may update, improve, or discontinue any part of the Services at any time. We do not guarantee that any specific content will remain available, and we do not guarantee uninterrupted availability of the website.

4. Acceptable Use

You agree to use the Services lawfully and in a manner that does not harm the website, our users, or our operations. In particular, you agree not to:

• Use the Services to distribute malware, spam, or phishing content.
• Attempt to gain unauthorized access to the website, servers, or related systems.
• Scrape, crawl, or harvest content at a rate that impairs site performance, or bypass any access controls.

The Services, including all text, training materials, structure, templates, and website content, are owned by jaqvenric or its licensors and are protected by intellectual property laws. Except as expressly permitted in these Terms, you may not copy, reproduce, modify, create derivative works from, distribute, publicly display, or otherwise exploit the Services or content.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal training and evaluation purposes, in accordance with these Terms. This license does not permit resale or redistribution of the materials as standalone products.

6. Third-Party Services and Links

The Services may reference third-party products or services (for example, industry terminology, component standards, or external training resources). If the website contains links to third-party websites, those links are provided for convenience only.

We do not control third-party websites and are not responsible for their content, policies, or practices. Your interactions with third parties are governed by their own terms and privacy notices.

7. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, jaqvenric disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We also do not warrant that the educational materials will meet your requirements or produce any particular outcome.

8. Limitation of Liability

To the fullest extent permitted by law, jaqvenric shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising out of or related to your use of (or inability to use) the Services.

To the fullest extent permitted by law, the total liability of jaqvenric for any claim arising out of or relating to the Services shall not exceed the greater of (a) the amount you paid to us in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for intentional misconduct).

9. Indemnification

You agree to indemnify and hold harmless jaqvenric from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of any law or the rights of a third party.

10. Force Majeure

jaqvenric shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, cyberattacks, power outages, or failures of hosting or cloud infrastructure providers.

11. International Use

The Services may be accessed from multiple countries. We make no representation that the Services are appropriate or available for use in every location. You are responsible for complying with local laws that apply to your access and use of the Services.

12. Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. If you are a consumer in the European Union, you may also benefit from mandatory consumer protection provisions of the laws of your country of residence.

Unless mandatory law requires otherwise, the courts with jurisdiction in the Czech Republic shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

13. Dispute Resolution

Before filing a formal claim, you agree to contact us and provide a brief, written description of the issue so we can attempt to resolve it informally. Unless mandatory law requires otherwise, you agree to allow at least 30 days for informal resolution.

Nothing in this section prevents either party from seeking appropriate relief in a court of competent jurisdiction where such relief is necessary.

14. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk, or acted inconsistently with the letter or spirit of the Terms.

Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law.

16. Entire Agreement

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and jaqvenric regarding the Services and supersede any prior or contemporaneous understandings on the subject matter.

17. Assignment

jaqvenric may assign or transfer these Terms (in whole or in part) in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of jaqvenric.

19. Changes to These Terms

We may update these Terms from time to time. Changes become effective 14 days after they are posted on this page, unless a shorter period is required for security or legal reasons. Your continued use of the Services after the effective date indicates acceptance of the updated Terms.

20. Electronic Communications

By using the Services and communicating with us electronically, you consent to receive communications from us electronically. You agree that electronic communications and notices satisfy any legal requirement that such communications be in writing.
